September 19, 2016: KAPLAN, FLORENCE V CHATSWORTH AT WELLINGTON GREEN, LLC
Allegations: While at NuVista Living at Wellington Green on October 17, 2015, the Resident was undergoing occupational therapy. The therapist performed the therapy so strongly that the Resident was in immediate pain. The therapist reported hearing a loud pop; however, the staff did not immediately notify the Resident’s family but instead ordered an x-ray which revealed a subluxation of the right shoulder that was not present before. As a result, the Resident underwent a second right shoulder replacement and subscapularis repair on October 20, 2015.
RESULT: Case is on-going.
September 1, 2016: MCCARTHY-SAX, ELAINE V CHATSWORTH AT WELLINGTON GREEN
Allegations: During the Resident’s stay at NuVista Living at Wellington Green beginning on November 12, 2014, the Resident was the victim of negligent and substandard care causing her to choke and die.

August 23, 2016: HOCHMAN, HARRIET V CHATSWORTH AT WELLINGTON GREEN, LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green on October 31, 2013 following a discharge from JFK Hospital where she underwent surgery to repair a broken left wrist. After admission, the Resident was noted to have “redness on her bottom” and later had an open area noted to buttocks. Later, the Resident had an infection of her sacral pressure sore which was noted to be a Stage II pressure ulcer on her sacral area. Thereafter, the sore was noted as a Stage III pressure ulcer on her sacral area, measuring 4.5 x 3.5 x 8. The Resident was discharged with a non-healing decubitus ulcer to the sacral area which cause pain for fourteen months until she underwent surgery to close the wound in December 2014.
RESULT: Case is on-going.
March 18, 2016: RASHKIN, SHIRLEY V CHATSWORTH AT WELLINGTON GREEN, LLC
Allegations: While at NuVista Living at Wellington Green, the Resident was a clear fall risk with the need for rehabilitative and nursing home care due to her hip surgery from a previous fall. On November 19, 2014, the Resident was left unattended in her wheelchair without the wheelchairs being properly locked in place, without a call arm/bell in reach of her and her wheelchair, resulting in the Resident being found lying on the floor. The Resident fell landing on her right side requiring her to go to surgery to correct her right distal radius and ulna fractures injuries due to the fall.
RESULT: Case is on-going.
December 8, 2015: GINSBURG, RONA V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green following hospitalization at Mt. Sinai Medical Center for an Extreme Lumbar Fusion (XLIF) and posterior lumbosacral L2-L5, S1 decompression and interbody fusion with pedicle screw fixation. Due to the negligence of the Facility, the Resident died to due to gastrointestinal bleed, lumbar spine disease, cardiac arrest, and lumbar spine fusion and laminectomy.
RESULT: Case was disposed by Settlement on May 26, 2017.
November 3, 2015: FRIEDMAN, SANDRA V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green on October 9, 2013. The Facility negligently failed to recognize the Resident’s progressing congestive heart failure, negligently failed to appropriately keep the Resident’s physicians informs of his fluid retention and significant weight gain, negligently failed to monitor his fluid intake and his urinary output, negligently treated his congestive heart failure symptoms as if he had a simple cough; and negligently failed to make arrangements to have the Resident transferred to the hospital.
RESULT: Case was disposed by voluntary dismissal on November 14, 2016.
October 6, 2015: OBOLENSKY, ANNE V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green on September 26, 2014 and was injured as the Facility failed to provide adequate and appropriate protective and support services including failing to respond to the Resident’s risk for injuries after her recent hip replacement surgery.
RESULT: Case was sent to Arbitration and is on-going.
September 30, 2015: FRIEDMAN, ROBERTA V CHATSWORTH AT WELLINGTON GREEN LLC DBA AS NUVISTA LIVING
Allegations: The Resident was admitted to NuVista Living at Wellington Green on October 31, 2014 for rehabilitation after a total left hip replacement. During the morning of November 1, 2014, the Resident needed to use the restroom and attempted to summon help via her call button. Despite repeated requests for assistance the staff at the Facility failed to attend to her needs. When she could no longer wait, the Resident attempted to go to the bathroom on her own and fell and reinjured her hip.
RESULT: Case was disposed on January 6, 2017
February 18, 2015: JOHNSON, KAREN A V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations:The Resident was admitted to NuVista Living at Wellington Green on February 23, 2013. The Resident was the victim of negligent and substandard care and/or treatment at the Facility causing her to choke and die.

February 12, 2015: DIPROSPERO, LAURA V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green on March 25, 2013 for rehabilitation secondary to a fracture. She required assistance from staff to perform her ADL’s. She remained at the Facility from March 25, 2013 until April 6, 2013 when she was readmitted to Wellington Medical Center. After 2 days at Wellington Medical Center, the Resident returned back to the Facility on April 8, 2013. Her skin was intact and free of infection. Eleven days later, the Resident was re-admitted back to Wellington Medical Center where it was noted she suffered from a UTI, confusion, and a Stage III pressure sore. The sacral pressure wound required wound care and painful debridements. The Resident wrongfully died on April 24, 2013.
RESULT: Case was disposed by Settlement on February 10, 2007.
November 1, 2013: KEANE, JEAN V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green on July 24, 2013. The employees of the Facility were negligent in their care and treatment of the Resident and deviated from acceptable standards of care and practice. As a result the Resident wrongfully died on August 6, 2012.
RESULT: Case was sent to Arbitration and disposed on July 2, 2015.
October 29, 2013: ALLEN, HELGA V CHATSWORTH AT WELLINGTON GREEN LLC
Allegations: The Resident was admitted to NuVista Living at Wellington Green between December 5, 2011 and December 25, 2011 following hospitalization at Jupiter Medical Center for elective surgery, a left total hip arthroplasty which was performed on December 1, 2011. ON December 25, 2011, the Resident suffered a fall resulting in a right subcapital femoral fracture and left greater trochanteric. These injuries caused permanent disability.
RESULT: Case was disposed on June 20, 2014.

Allegations: A guest invited onto the premises tripped and fell on a wooden step which the Facility allowed toe main on the floor in a dangerous condition.
