Allegations: While at Boynton Beach Rehabilitation Center on or about November 28, 2015, the Resident suffered multiple gruesome injuries due to the Facility’s negligence including multiple decubitus ulcers, gangrene and sepsis.
RESULT: Case disposed by Settlement on May 23, 2017.
February 28, 2017: MALICK, PETER V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: During the Resident’s stay at Boynton Beach Rehabilitation Center from July 15, 2015 through August 30, 2015, the Resident’s rights were violated by the Facility.
RESULT: Case is on-going.
August 11, 2016: SWISLOW, MARLENE V SOVEREIGN HEALTHCARE OF BOYNTON BEACH, LLC
Allegations: Boynton Beach Rehabilitation Center neglected the Resident causing severe bodily injuries, including but not limited to a gruesome Stage IV pressure sore to the buttocks. Due to the injuries, the Resident wrongfully died on December 5, 2015.

March 26, 2015: WIENER, SANDRA V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: Boynton Beach Rehabilitation Center admitted the Resident on March 22, 2013. The Resident wrongfully died on April 1, 2014 due to the Facility’s failure to provide adequate and appropriate care.
RESULT: Case disposed by Settlement on March 3, 2017.
April 25, 2014: FREDERICKS, CATHERINE V LEWIS, PRINCELLA
Allegations: Boynton Beach Rehabilitation Center wrongfully confined the Resident by preventing her from having contact with her own attorney and by refusing to provide her authorized representatives with her medical records pursuant to a valid release. Additionally, the Facility arranged to have control over the Resident so that they could receive substantial Medicaid payments and be paid large sums from the government so long as the Resident remained at the Facility.
RESULT: Case was disposed due to lack of prosecution on January 20, 2016.
April 8, 2014: MARINI, ELENA V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center with a diagnosis of dementia, bacteremia, humeral and nasal fractures and psychosis. He was at high risk for falls and the development and deterioration of pressure ulcers, given his conditions and medications. The Facility failed to prevent the Resident from suffering from the development and/or deterioration of serious injuries including, but not limited to, falls, lacerations, infection, malnutrition, dehydration and the development/deterioration of pressure ulcers.
RESULT: Case was sent to Arbitration and disposed due to lack of prosecution on January 17, 2017.
May 17, 2013: PROBY, KATHERINE B V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The staff and employees at Boynton Beach Rehabilitation Center failed to properly monitor and supervise the care and treatment provided to the Resident in order to prevent her from suffering falls and unexplained injuries, and suffering the development and deterioration of infections. As a result, the Resident wrongfully died on November 23, 2012.
RESULT: Case was sent to Arbitration and is on-going.
October 29, 2012: ESTATE OF ARTHUR OPPENHEIM V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center on August 25, 2010 and was discharged on October 7, 2010. Due to the Facility’s breach of duties owed to the Resident, he suffered numerous decubitus ulcers to his left knee, dorsal right foot, dorsal left foot, left heel, sacrum, and left ischium, unexplained bruising, septicemia, septic shock, severe sepsis and weight loss. Due to these injuries, the Resident wrongfully died.
RESULT: Case has reached a tentative settlement for $300,000 on April 1, 2016 and is on-going.
January 11, 2011: ESTATE OF ALEXANDER HITZ V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center on September 29, 2009 and was discharged on October 11, 2009. Due to the Facility’s breach of duties owed to the Resident, he suffered incorrect risk assessment for decubitus ulcers (coded mild risk), incorrect assessment for falls (coded no risk), multiple infections including urinary tract infections, sepsis, cellulites, urosepsis and infection of surgical site, worsening of sacrum decubitus ulcer, and uncontrolled bloody sugar. Due to these injuries, the Resident wrongfully died.
RESULT: Case was sent to Arbitration and disposed by Settlement on September 19, 2012.
December 31, 2008: RIENDEAU, RITA V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center on March 9, 2007 and was discharged on March 10, 2007. Due to the Facility’s breach of duties owed to the Resident, the Resident suffered a fall at the facility resulting in a left hip fracture and a dislocated right hip. Due to these injuries, the Resident wrongfully died.
RESULT: Case was disposed on August 4, 2014.
October 2, 2008: LIPTON, SHIRLEY V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center on January 5, 2007 for rehabilitation following coronary bypass surgery. The Resident fainted while standing in the bathroom which caused her to be transported to Bethesda Hospital where she was diagnosed with acute renal insufficiency secondary to dehydration, urinary tract infection including urosepsis spreading to her blood and a wound fungal infection to her surgical site.
RESULT: Case was disposed on June 25, 2009.
September 11, 2008: TAMES, ESTHER V SOUTHERN HEALTHCARE MANAGEMENT LLC
Allegations: The Resident was admitted to Boynton Beach Rehabilitation Center on December 22, 2006. After less than one month at the facility, the Resident suffered a preventable incident that resulted in spinal fractures, permanent bodily injury, the need for surgery and ongoing pain and suffering for the duration of her life.
RESULT: Case was disposed on May 18, 2009.
February 28, 2007: CURCIO, ADRIENNE V SOVEREIGN HEALTHCARE OF BOYNTON BEACH LLC
Allegations: On June 24, 2005, the Resident was escorted to the restroom via wheelchair by an employee for Boynton Beach Rehabilitation Center. The employee left the Resident unattended for a period of time where the Resident fell off the toilet fracturing her neck and was placed in a “halo” vest and forced to use the aid of a feeding tube for the next several months, required home health care, and later died on July 15, 2006.
RESULT: Case disposed by Settlement for $58,500.00 on March 12, 2013.
