Allegations: The Resident had been previously hospitalized at Jackson Memorial Hospital for chronic kidney disease. He was transferred to Unity Health and Rehabilitation Center for rehabilitation and was expected to leave the facility in a health condition. Upon admission, the Resident required some assistance, however, was able to ambulate, but needed some assistance with ADL’s. The short range plan was for him to return home. He was to receive physical therapy, daily skilled nursing, pain management, observation, and supervision. Almost immediately, the Resident was subject to ill-advised treatment, incorrect medication and dosages, improper injections, the application of improper assistive devices, such as diapers, and an infection of his big toe after his toenails were clipped. The infection progressed and resulted in gangrene and the loss of a portion of his toe. He required hospitalization at Jackson Memorial Hospital and University of Miami Hospital and Clinics.

Allegations: The Resident was admitted to Aventura Hospital in need of certain angiographic services and care and treatment. Following the care and treatment, the Resident was severely and neurologically impaired and remained a patient of Aventura Hospital until moving to Unity Health and Rehabilitation Center. At Unity Health and Rehabilitation Center, the Resident was improperly cared for resulting in a stage 4 decubitus ulcers developing on his heels, buttocks and spine, and allowed infection to set in without proper care and treatment. Due to the above, the Resident suffered grievous personal injury and eventual death.

Unity Health and Rehabilitation Center failed to keep the Resident’s skin clean, dry and free from feces.
