March 8, 2017: WEISS, MARVIN C V GARDENS COURT MEDICAL INVESTORS LLC
Allegations: The Resident was at The Gardens Court beginning on February 16, 2016. During her admission, the Resident contracted C-Diff because the Facility failed to recognize the likelihood that the Resident had C-Diff when symptoms began as early as February 28, 2016. Upon her admission to the ER of Jupiter Medical Center, the Resident was positive for C-Diff and suffering acute kidney injury. The Resident eventually died due to C-Diff sepsis.

November 13, 2012: MORAN, EMERSON V GARDENS COURT MEDICAL INVESTORS LLC
Allegations: While at The Gardens Court, the Resident was transported by a non-trained healthcare professional back to her residency while in a wheelchair. The Resident’s right foot got caught on the flooring as a result of no foot pedals on the wheelchair. The right foot and leg was bent under the wheelchair causing a loud pop as the femur between her right hip joint and right knee fractured. The Resident was immediately transferred to Palm Beach Gardens Medical Center. She was found to have suffered a traumatic fracture to the distal mid femoral shaft on the right above her total knee replacement. She underwent an open reduction and internal fixation of the right distal femoral shaft fracture with bone graft including a plate and thirteen screws. The Resident then suffered a neurological event as a result of the underlying injury of femur fracture including the necessary surgery and the stresses and infirmities and eventually expired.

RESULT: Case Disposed by Settlement on August 13, 2014.

March 9, 2012: HULLIHAN, WILLIAM V GARDENS COURT MEDICAL INVESTORS LLC DBA THE GARDENS COURT
Allegations: The Resident was transferred to The Gardens Court on September 11, 2009 for rehabilitation care with an anticipated discharge on November 6, 2009. During September 11-18, 2009, the Resident suffered a dislocation of his left hip replacement prosthesis and on September 18, 2009 he was transferred to the ER of Palm Beach Gardens Medical Center confirming a diagnosis of left hip dislocation requiring a closed reduction of the dislocation.

RESULT: Case disposed on July 30, 2015.

January 18, 2012: BATCHER, JUDITH V GARDENS COURT LLC
Allegations: The Resident was admitted to The Gardens Court on March 14, 2010 where she remained until being discharged home on May 16, 2010. At home on May 16, 2010, it was evident to her family that she was not well and she was taken to the hospital where it was learned she was suffering from a urinary tract infection causing complications. The Resident was transferred for a second admission at The Gardens Court where she began vomiting. The staff negligently placed her alone in a bed unsupervised when she vomited, slipped on her vomit and hit her head. The trauma from the fall resulted in an acute brain hemorrhage and a fractured skull and the Resident wrongfully died three days later on May 23, 2010.

RESULT: Case transferred to Federal Court on February 29, 2012.

September 9, 2011: STONEMAN, BARBARA V GARDENS COURT MEDICAL INVESTORS LLC DBA THE GARDENS COURT
Allegations: The Resident was admitted to The Gardens Court on January 22, 2009. The staff failed do document changes in the Resident’s condition, including her risk for stroke. Due to the Facility’s failures, the Resident wrongfully died on January 26, 2009.

RESULT: Case transferred to Federal Court on November 7, 2011.

April 3, 2009: MORRIS, HILDA P V GARDENS COURT MEDICAL INVESTORS LLC
Allegations: Resident was admitted to The Gardens Court and determined to be at risk for injury and was determined to be at high risk for falls. The Resident suffered a fall by falling out of bed on July 12, 2008 which caused her injury.
