Allegations: The Resident was admitted to Avante at Boca Raton where she developed a horrific decubitus ulcer to the sacral area which the Facility failed to identify, document and treat. The injury has required multiple surgeries including debridement surgery, skin graft surgery and colostomy surgery and the injury still has not healed.

March 21, 2017: ROLAND, GREGORY V AVANTE AT BOCA RATON INC
Allegations: While at Avante at Boca Raton, the Resident was a victim of negligent, inadequate and substandard care and treatment and violations of her nursing home resident’s rights. As a direct result, the Resident developed a large Stage IV pressure ulcer which required surgical debridement, pressure ulcers on her heels, contractures of her upper and lower extremities, infections, the need for surgical intervention to correct damage caused by substandard and dangerous care of her airway, trachea and overall pulmonary condition.

Allegations: While at Avante at Boca Raton, the Resident suffered injuries which included skin integrity issues, including a stage II pressure ulcer to the right buttock, a stage III pressure ulcer to the coccyx, a stage IV pressure ulcer to the sacrum, an open area to the left ischium, stage I pressure ulcers to the bilateral heels, a stage I pressure ulcer to the left lateral foot, a stage I pressure ulcer to the left hip, an open area to the left ischium, and an unstageable deep tissue injury to the right hip, infections, including multiple urinary tract infections, an oral infection, MRSA, Providencia stuartii, and Escherichia Coli infections to a sacral wound, osteomyelitis to a sacral wound, an extended spectrum beta lactamase infection, clostridium difficile, and urosepsis, and weight loss of 19.4 pounds.

Allegations: The Resident was admitted to Avante at Boca Raton following a fall and hip surgery. Upon admission, the Resident was at risk for skin breakdown. Despite this classification, the Resident was neglected while at Avante at Boca Raton, and subsequently developed skin breakdown in the form of pressure sores.

Allegations: The staff and employees at Avante at Boca Raton failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to the Resident and to monitor her respiratory status and take appropriate action, including notifying her doctor and transferring her to the hospital, when her condition deteriorated. As a result, the Resident suffered injuries, including respiratory arrest and death.

Allegations: The Resident suffered a preventable fall at Avante at Boca Raton due to Avante at Boca Raton’s negligence, which resulted in serious bodily injuries including a broken neck. The Palm Beach County Medical Examiner reviewed the case and determined that the manner of death was not natural, bust instead was “accident” in referencing the above-described incident at Avante at Boca Raton, and the cause of death was determined to be blunt neck trauma.

Allegations: Avante at Boca Raton failed to properly assess the Resident and formulate a care plan for him which caused him to suffer a skin tear to his left lower extremity. The Resident also suffered a gash to his right leg which resulted in him being admitted to the Boca Raton Regional Hospital and requiring staples in his right leg. Avante at Boca Raton failed to arrange for proper emergency medical attention for his right leg injury which resulted in the Resident losing a large amount of blood and requiring a blood transfusion to replace the lost blood. The Resident also suffered from a coccyx decubitus ulcer, left heel decubitus ulcer, a sacral decubitus ulcer which caused debridement surgery at Coral Springs Medical Center.

Allegations: Avante at Boca Raton exposed the Resident to injury, including multiple decubitus ulcers to his sacrum with necrosis requiring debridement to his right buttock with bone exposure, to his left buttocks requiring debridement, to his right posterior thigh with necrosis requiring debridement, to his left posterior thigh requiring debridement, to his left shoulder, to his upper left back, to his mid-left back with eschar, multiple decubitus ulcers to mid-right back, two decubitus ulcers to right stump, decubitus ulcer to left stump, and decubitus ulcer to left elbow, weight loss, diarrhea requiring a rectal tube, dehydration, multiple urinary tract infections, VAP, cellulitis of abdominal fistula, MRSA infection of decubitus ulcers, infected G-tube site, and sepsis. As a result, the Resident died.

Allegations: Avante at Boca Raton dropped the Resident onto the bathroom floor causing the skin in her knee to tear. Avante at Boca Raton failed to properly implement and monitor a sliding scale for insulin coverage with use of a NOVO LOG as ordered by the attending physician. Avante at Boca Raton failed to properly record blood glucose readings and insulin dosages, and failed to notify the attending physician when the Resident’s blood sugar reading measured over 400 on multiple occasions.

June 29, 2009: ESTATE OF EMILIE K THEODORE V AVANTE AT BOCA RATON INC
Allegations: The Resident suffered from multiple injuries at Avante at Boca Raton, including a stage II decubitus ulcer on her coccyx, a fall from her wheelchair, had critical lab values indicating hyperkalemia and impeding renal and respiratory failure, which a doctor was not informed about. The Resident was found unresponsive and admitted to Boca Raton Community Hospital with diagnoses that included, but not limited to: hyperkalemia with associated cardiac arrhythmia, hypotension, acute renal failure and hypothermia. She required emergent hemodialysis. Due to the above injures, the Resident died.
Result: Case Disposed on July 5, 2012.
March 16, 2009: SELTZER, ILYSA V GRE BOCA RATON INC
Allegations: An invitee of Avante at Boca Raton slipped and fell and suffered serious injuries due to the negligent manner in which said premises were operated and/or maintained. Avante at Boca Raton created a dangerous and defective condition by negligently and carelessly failing to properly maintain an air condition unit located adjacent to a walkway on the premises such that the air condition unit leaked water which was allowed to accumulate on the walkway, causing a slipper and dangerous condition, which caused the invitee to slip and fall and suffer serious and permanent injuries.

May 29, 2008: MULLER, JERRY V GANOT CORPORATION
Allegations: Avante at Boca Raton recognized that the Resident had a history of dementia and falls. Even though the fall risk assessment form was not fully completed, Avante at Boca Raton did recognize that the Resident required extensive assistance and that her safety was an issue. The nursing staff graded the Resident an 18 out of 20 on the Braden scale, which placed her at low risk for skin breakdown. She was not suffering from any skin breakdown at the time of admission. The Resident eventually fell out of her wheelchair and suffered a fracture to the neck of her left humerus. Additionally, the Resident suffered from a pressure sore that had developed on the coccyx. The wound was documented as a Stage III, with dimensaions of 5.5cm by 4cm by .2cm. The wound grew and was described as having a purulent odor. Eventually the Resident was discharged to West Boca Hospital and passed away with a cause of death listed as decline in function.
