Allegations: The Resident was admitted to Lake View Care Center at Delray on August 31, 2016. On September 7, 2016, the Resident suffered a preventable fall at the facility due to the facility’s negligence and failure to have appropriate fall precaution interventions in place. The fall resulted in serious bodily injuries, including a broken hip that required surgery and the Resident wrongfully died on September 29, 2016. The death certificate confirmed that complications from the hip fracture caused his death.

Allegations: During the Resident’s stay at Lake View Care Center at Delray, the Facility failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to the Resident in order to prevent her from suffering falls and unexplained injuries. Due to the falls, the Resident suffered a dislocated hip.

Allegations: The Resident was at Lake View Care Center at Delray from approximately March 10, 2012 to May 2, 2012. Prior to coming to the facility, the Resident fell at home and had hip surgery at Delray Medical Center. He was discharged to Lake View Care Center at Delray for rehabilitation where was injured due to abuse and neglect, including a serious 3 ½ deep dash to his lower left extremity and infections such as C-Diff. As a result, the Resident wrongfully died on May 5, 2012.

August 2, 2013: KILMAN, LARRY V DELRAY GROUP LLC DBA LAKEVIEW CARE CENTER AT DELRAY
Allegations: During the Resident’s stay at Lake View Care Center at Delray, the Facility failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to the Resident in order to prevent her from suffering falls and unexplained injuries. The Resident suffered a catastrophic fall on July 4, 2011, which resulted in her suffering a fractured hip.

RESULT: Case disposed on January 16, 2014.

Allegations: The Resident was at Lake View Care Center at Delray starting January 12, 2010. A fall occurred on January 24, 2010 and the Resident was a high fall risk resident. Allegations: During the Resident’s stay at Lake View Care Center at Delray, the Facility failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to the Resident in order to prevent her from suffering falls and unexplained injuries. The Resident suffered a catastrophic fall on January 7th, 2011 which resulted in her suffering an orbital fracture and eye trauma causing permanent loss of vision.

Allegations: The Resident was admitted to Lake View Care Center at Delray from November 9, 2008 through January 2009. On initial assessment, the Resident was noted has having no pressure ulcers but had some redness on the left buttocks. However, due to the negligence and failure to provide appropriate nursing home care, the Resident developed a Stage IV necrotic pressure ulcer on his buttocks. It was 3.7 x 2.5 cm Stage IV pressure ulcer on his buttocks that became necrotic and infected.

RESULT: Case was disposed on October 23, 2012.

November 18, 2010: SHALOM, SALTIEL C V DELRAY GROUP LLC DBA LAKEVIEW CARE CENTER AT DELRAY
Allegations: The Resident was admitted to Lake View Care Center at Delray between September 11, 2009 through October 5, 2009. The Resident was admitted from Delray Medical Center for physical therapy and rehabilitation and noted to be high risk for development of pressure ulcers. The Resident received no treatment for any pressure ulcer until September 18, 2009. As of September 21, 2009, a coccyx wound was identified as a Stage II presenting clinically as a Stage III full thickness wound measuring 1.5 x 1.0 x .1 cm and wound bed 50% soft slough and 50% dark pink moist tissue with minimal serous drainage and no odor. Over time, the wound presented as a Stage IV pressure ulcer with wound bed of 70% soft necrotic tissue, 30% slough non odorous. A wound culture of the coccyx ulcer showed heavy growth of Proteus Mirabilis and the Resident had to undergo multiple debridement procedures.

RESULT: Case was disposed by Settlement on November 5, 2012.

April 14, 2009: KASPER, LAWRENCE V DELRAY GROUP LLC DBA LAKE VIEW CARE CENTER AT DELRAY
Allegations: The Resident was admitted to Lake View Care Center at Delray on November 1, 2007 where the Resident slipped and fell in the bathroom as a result of the facility’s carelessness in attending to the Resident’s needs which caused injury to the body and extremities of the Resident.

RESULT: Case was disposed on January 5, 2011.

February 17, 2009: DANNENBERG, CLAIRE V DELRAY GROUP LLC
Allegations: The Resident was admitted to Lake View Care Center at Delray on October 5, 2006 for the sole purpose of improving his ambulation and mobility. The Resident was a high fall risk resident and the facility did not provide assistance when he needed to use the bathroom as there was no response to his call bell, no one performing hourly rounds to check on him, no bed alarm to alert the staff, no walker or cane for him to support himself and no padding on the floor to cushion his fall. As a result, the Resident fell and fractured his spine a the L1 and L2 levels.

RESULT: Case was disposed on October 2, 2012.

December 5, 2008: ALTMAN, ELAINE V DELRAY GROUP LLC
Allegations: The Resident was admitted to Lake View Care Center at Delray on November 16, 2006. On December 7, 2006, another resident at the Facility entered the room and collided his wheelchair with the Resident who called for help. The facility did not respond which required the Resident to get up and remove the other resident from her room. In doing so, the Resident fell and sustained serious injuries.

RESULT: Case was disposed by Settlement on January 23, 2013.

The Resident developed progressive deterioration and skin decubitus ulcers which were on her heels and coccyx. A culture of the coccyx wound revealed heavy growth of E.Coli and Morganella which required hospitalization from suffering septic shock for a Stave IV wound to her sacrum and left and right heels.
