July 1, 2016: ZUCKERMAN, JANET V HEARTLAND OF BOCA RATON FL LLC.
Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident was weak and congested, had frequent coughing, had complaints of congestion, a heart rate of 129, and an O2 SAT of 92%. She was sent to West Boca Medical Center where her diagnosis included septic shock and pneumonia. The Resident later died due to the negligence and delay in diagnosis.

July 1, 2015: RADER, DONNA C V MANOR CARE OF BOCA RATON FL LLC.
Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident complained of low back pain and felt “bad” and weak. She presented with blood pustules in her mouth. Labs were taken at Heartland Health Care & Rehabilitation Center of Boca Raton and the Resident was later urgently transferred to Delray Medical Center from Manor care for further evaluation and treatment for a diagnosis of thrombocytopenia.

RESULT: Ongoing case.

December 19, 2014: RIVERA, ZELEIDA V HEARTLAND OF BOCA RATON FL LLC.
Allegations: Resident was admitted to Heartland Health Care & Rehabilitation Center of Boca Raton for rehabilitation and therapy after a total knee replacement. She could not ambulate or bear weight on her leg. The Resident was entirely wheelchair dependent. A staff member of Heartland Health Care & Rehabilitation Center of Boca Raton failed to secure the Resident in her wheelchair by failing to place the wheelchair foot rests on the wheelchair, which caused the Resident’s surgical leg to get caught underneath the wheelchair as it was pushed. This resulted in a worsening of her injury.

RESULT: Case Disposed by Settlement: July 26, 2016.

July 14, 2014: JARA, CATALINA V HCR MANORCARE MEDICAL SERVICES OF FLORIDA LLC.
Allegations: A Certified Nursing Assistant working at Heartland Health Care & Rehabilitation Center of Boca Raton slipped and fell on a slippery liquid substance, believed to be water, which had accumulated on the floor on, under, and around one of the rubber mats near the window. Due to the fall, the CNA sustained injuries.

RESULT: Case Disposed by Settlement: October 18, 2016.

January 8, 2014: POLIZZOTTO, PHILLIP V HEARTLAND OF BOCA RATON FL LLC.
Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident was not properly monitored and supervised to prevent the Resident from suffering falls. The Resident sustained a fall event which resulted in her suffering a fractured hip.

March 28, 2013: ESTATE OF PETER RUSSO V HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA LLC
Allegations: The Resident was admitted to Heartland Health Care & Rehabilitation Center of Boca Raton on March 20, 2012 for short term rehabilitation. He had no skin breakdown. Due to the negligence of the Facility, within two months the Resident developed serious wounds which were so bad that his tendon and bone were exposed. The Resident was transferred to a hospital on May 25, 2012 where he was diagnosed with osteomyelitis and MRSA and died on June 1, 2012.

RESULT: Case disposed on January 14, 2014.

December 5, 2012: GURECK, SANDRA L V HEARTLAND OF BOCA RATON FL LLC.
Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident was negligently treated resulting in multiple falls with one resulting in a left hip fracture requiring surgery, another fall resulting in the dislocation of the replaced left hip; numerous infections including multiple urinary tract infections with Enterobacter cloacea and enterococcus faecalis, a urinary tract infection with oxacillin resistant staph aureus, multiple occasions of left lower lobe pneumonia, C-Diff, and sepsis; multiple decubitus ulcers to the Resident’s left buttock, right buttock, left lateral leg, left ankle and his sacrum; rash to his neck and face; dehydration; malnutrition; and weight loss. These injuries led to the wrongful death of the Resident.

November 2, 2011: EVANS, SHENETHA V HEALTH CARE AND RETIREMENT CORPORATION IF AMERICA LLC
Allegations: The Resident was admitted to Heartland Health Care & Rehabilitation Center of Boca Raton on September 2, 2010 until her final discharge on November 17, 2010. During the Resident’s admission, the Facility failed to provide the Resident with adequate and appropriate care which resulted in skin breakdown, infection and amputation.

Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident had a development and deterioration of respiratory failure due to the staff and employees failing to develop an adequate care plan and properly monitor and supervise the care and treatment provided to the Resident.

Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident sustained injuries including multiple skin tears; unmanaged blood sugar, nausea, vomiting, diarrhea and sepsis. These injuries led to the death of the Resident.

April 5, 2010: ROTH, ERNESTINA V HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA.
Allegations: Heartland Health Care & Rehabilitation Center of Boca Raton staff failed to prevent him from experiencing a fall, failed to ensure there was timely treatment of a urinary tract infection, failed to prevent and/or provide protective measures to prevent the breakdown of skin both of the Resident’s heels, which subsequently led to the development of decubitus heel ulcers. These injuries led to the death of the Resident.

March 12, 2009: HARRIS, JOAN V HEARTLAND OF BOCA RATON FL LLC.
Allegations: A guest of a resident was injured by Heartland Health Care & Rehabilitation Center of Boca Raton for failing to adequately and properly maintain the doors at its facility. The facility was alleged to have maintained a negligent design of the doors which caused the guest to fall violently to the ground where she sustained injured to her body and extremities.

Allegations: While at Heartland Health Care & Rehabilitation Center of Boca Raton, the Resident suffered permanent and irreversible injuries including life threatening sepsis, development of toxic megacolon, surgical removal of his colon and portions of his bowel, creation of a colostomy and/or ileostomy requiring him to wear a bag to collect feces one the side of his abdomen, development and/or progression of bed sores resulting in amputation of one of his legs and deterioration of his physical condition to the point where he has been required to remain in a nursing home for the rest of his life.

April 24, 2007: ESTATE OF ANN L MATSON V HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA
Allegations: The Resident was admitted on November 29, 2005 until her discharge on January 29, 2006. Due to the Facility’s negligent acts and omissions, the Resident suffered from numerous infections, including vancomycin resistant enterococcus urinary tract infection and strep bacteremia. She also had a rash under her chest, suffered from dehydration and malnutrition, suffered from at least two falls, one resulting in a right femur fracture that extended into the previous right total hip arthroplasty and required surgery. These injuries caused the Resident’s death on February 8, 2006.
