April 1, 2016: MERMER, GLEN V HEARTLAND OF BOYNTON BEACH FL LLC DBA HEARTLAND HEALTH CARE CENTER – BOYNTON BEACH
Allegations: The Resident was admitted to Heartland Health Care Center – Boynton Beach on July 13, 2015 where he suffered a preventable fall within hours after being admitted to the Facility, resulting in a fatal head injury. The Facility also failed to follow appropriate protocol to have the Resident timely and appropriately assessed and treated after the incident. As a result, the Resident wrongfully died on July 24, 2015.

RESULT: Case was disposed on October 24, 2016.

January 8, 2016: KHACHADOURIAN, KELLY V HEARTLAND OF BOYNTON BEACH FL LLC.
Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident suffered from decubitus ulcers which included numerous Stages I through IV, and unstageable decubitus ulcers on her lower extremities and throughout her body, many of which became infected leading to the resident’s death.

RESULT: Ongoing case in Arbitration.

Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained multiple falls resulting in several skin tears and on the elbow and right side of the head. Resident also sustained infections, including septic shock and bacterial pneumonia and numerous diabetic ulcers leading to the resident’s death.

RESULT: Case Disposed by Settlement: July 1, 2016.

Allegations: Resident suffered falls, skin breakdown and malnutrition while as a resident at Heartland Health Care Center – Boynton Beach leading to death.

November 8, 2013: BEDSWORTH, DOLORES V HEARTLAND OF BOYNTON BEACH FL LLC.
Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident fell on his buttocks, tilted his head and banged his head against a wall resulting in a broken neck along with other significant and permanent injuries and sequela and the resident’s death. There was also a delay in transporting the resident with a broken neck to the hospital.

Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained numerous falls resulting in skin tears and bruising, multiple infections including bibasilar pneumonia, and an infection to her left great toe; the development of scabies on two separate occasions; bruising to her upper body; bruising to her wrist; and an abrasion to her left third toe.

Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained malnutrition, dehydration, decubitus ulcers to left heel and sacrum, multiple infections including urinary tract infections with E.Coli, pseudomonas, Keratoconjuctivitis, and orchitis/epididymitis, acute renal failure, contractures, and anemia.

RESULT: Ongoing Case.

February 13, 2012: LOTZ, JUDITH H V HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA.
Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained multiple falls resulting in bruising and hematoma to the right side of her forehead; numerous infections including several bouts of pneumonia, frequent episodes of MRSA, numerous urinary tract infections with E.Coli, multiple skin problems including scabies, rashes, and extremely dry skin; and unexplained bruises, skin tears and lesions.

RESULT: Case Disposed by Settlement: February 20, 2014.

Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained multiple falls, which on one occasion caused a hematoma to the left side of his forehead, abrasions, rashes, bruising, skin tears, urinary tract infections, dehydration, and improper administration of medication.

Allegations: The Resident sustained a dislocated hip and unexplained injuries due to lack of supervision and inadequate staffing at Heartland Health Care Center – Boynton Beach.

January 22, 2010: ESTATE OF GEORGE A DAHMER V LAKE WORTH ENTERPRISE LLC DBA LAKE WORTH MANOR.
Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident sustained significant multiple decubitus ulcers which progressed to Stage IV heel ulcers and a coccyx ulcer. The facility also failed to maintain the resident’s weight, prevent falls, infection of the decubitus ulcers and urinary tract infection. These injuries led to the resident’s death.

RESULT: Jury Verdict: $800,000 compensatory damages and $975,000.00 in punitive damages. Satisfaction of Final Judgment by Defendant on June 17, 2015.

April 25, 2008: NOVAK, LARRY V HEARTLAND OF BOYNTON BEACH FL LLC.
Allegations: While at Heartland Health Care Center – Boynton Beach, the Resident was given Seroquel as an unlawful chemical restraint. Seroquel was contraindicated in elderly dementia patients, especially in this resident with prior cardiac conditions because it can cause sudden death.

RESULT: Case Disposed by Settlement: August 9, 2010.

October 3, 2007: USHER, BENJAMIN G V HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA
Allegations: The Resident was admitted to Heartland Health Care Center – Boynton Beach from September 6, 2006 to October 30, 2006. The Facility improperly fed the Resident and then failed to timely perform the Heimlich maneuver or any other lifesaving maneuvers. As a result, the Resident became nonresponsive on October 30, 2006. The Resident then wrongfully died on November 1, 2006.
