Allegations: The Resident at Atrium of Boca Raton had Alzheimer’s disease and was a threat to injure and/or otherwise endanger herself. The facility failed to protect the Resident from suffering injuries and falls and failed to respond to changes in nutritional status, mental status, and complaints of pain. As a result the Resident suffered permanent bodily injury.
RESULT: Case is ongoing.

Allegations: While at the Atrium of Boca Raton, the Resident suffered multiple falls some documented and some undocumented on or about August 6, 2012, January 13, 2013, February 5, 2013, March 13, 2013, May 19, 2013, June 2, 2013, June 3, 2013, June 13, 2013, June 24, 2013 all of which may it very clear that the Resident required additional care and supervision and/or could not have her needs properly met at the facility. On June 30, 2013, the Resident fell again resulting in a fractured hip and other injuries; however, the fall was not discovered until July 2, 2013 when the Resident was found in bed, in pain and unable to move. The facility did not have the Resident examined until about July 4, 2013. Thereafter, the Resident fell again on or about August 16, 2013, February 7, 2014, and on March 6, 2015 where the Resident sustained additional injuries.
RESULT: Case was disposed by settlement on March 20, 2017.
